Rule 79
Promotion based on performance and experience evaluation
(1) According to section 35 of the Act, the promotion based on the evaluation of performance and experience will be as follows:-
(a) According to sub-section (1) or sub-section (2) of section 35 of the Act, applications will be invited from the employees who have completed their service period within one month on Ashwin 1st and Chaitra 1st.
(b) Within two months of the expiry of the deadline for submitting the application form, the promotion committee as per sub-section (4) of section 35 of the Act will scrutinize all the application forms received and recommend the promotion within the month of Paush and Ashadha so that the seniority is maintained from the 1st of January and the 1st of Shrawan.
(c) In accordance with clause (b), the notice of promotion recommendation should be made public. The employee who is not satisfied with the said recommendation can file a complaint before the Public Service Commission within twenty one days.
(d) If an employee is promoted while investigating the complaint according to clause (c), the Public Service Commission will include the name of such employee in the same promotion and recommend for promotion.
(e) The Public Service Commission may review the promotion recommendation within fifteen days from the date of filing the promotion complaint even in the case of employees recommended by the promotion committee during the hearing of the complaint.
(2) Notwithstanding anything written in sub-rule (1), an employee whose name is included in the promotion list in accordance with this rule is not appointed for promotion, but if his name is included in the promotion based on performance evaluation, he will be asked to choose one of the promotions within fifteen days of the publication of the promotion list in accordance with this rule. will be given
